End User License Agreement (EULA)
Trial Fonts License

The EULA is an agreement between you as the licensee and phospho. By downloading, installing, and using phospho Trial Fonts you accept the terms of this agreement as stated below. phospho grants you a non-exclusive license to use the Trial Fonts within the terms and conditions of this agreement. This agreement replaces and supersedes any previously made oral or written proposal or agreement between phospho and the licensee.

This License is provided solely to allow testing and evaluation of phospho fonts in a desktop application environment. Any use other than for testing and evaluation purposes is prohibited.

phospho may apply technical limitations or identifying measures to Trial Fonts to distinguish them from fully licensed font software.

Allowed Uses

• You may use the Trial Fonts for testing or evaluation purposes within your company only. Any commercial or public use is strictly prohibited.
• You may use the Trial Fonts for creating test visualizations for presentations to your client. Such presentations are allowed on prints and screen.
• You may embed the Trial Fonts in PDF documents solely for presentation purposes. Such PDFs must be secured to allow viewing only and must not permit editing or extraction of the embedded fonts.
• As a student, you may use the Trial Fonts for projects in the course of your education only. Please bear in mind that character set is limited and features like Kerning and Ligatures may be excluded from the scope of the Trial Fonts. phospho offers students discounts for fully functional fonts.

Restrictions on Use

• You must not use the Trial Fonts for any commercial purposes. This includes, but is not limited to any work that is distributed, published, or otherwise made available outside of your organization.
• You must not embed the Trial Fonts in websites, end-user applications, digital publications (including e-books), or cloud-based platforms.
• You must not reformat or regenerate the Trial Fonts for compatibility with another operating system.
• You must not change or modify the font names used as identifying tags in the font software in any form or manner.
• You must not modify, adapt, translate, reverse engineer, decompile, disassemble, alter, or otherwise attempt to discover the source code of the Trial Fonts or the designs embodied therein.
• You must not share the Trial Fonts with any individual, entity, or organization outside of your organization.

Copyright

You acknowledge phospho retains full ownership of the Trial Fonts, and all intellectual property rights, including copyright, relating to the Trial Fonts.

Termination

This Agreement is effective until terminated. It will terminate automatically without notice from phospho if the Licensee fails to comply with any provision contained herein. Upon termination, you must destroy all copies of the Trial Fonts and related materials.

Warranty, Liability & Governing Law

The Font Software is provided “as is”. phospho warrants the Font Software to be free from defects in materials and workmanship under normal use for a period of twenty-one (21) days from the date of delivery. phospho shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the Font Software.

This Agreement is governed by the laws of the Republic of Austria. Place of jurisdiction is Vienna, Austria.
